Nature of Services
By checking the “I Agree” box or completing payment, the Purchaser acknowledges they have read, understood, and agreed to be bound by these terms. These Terms constitute the entire agreement and may only be modified by Aquatic Solutions. Electronic acceptance constitutes a legally binding signature. If the Purchaser is not the Participant, the Purchaser represents that they have authority to bind the Participant to these Terms. If any provision is held unenforceable, the remaining provisions shall remain in full force and effect. Aquatic Solutions shall not be liable for cancellations or delays caused by events beyond its reasonable control, including but not limited to weather, facility closure, public health emergencies, or government action. The Participant agrees to indemnify and hold harmless Aquatic Solutions from any claims arising out of the Participant’s conduct, violation of these terms, or failure to follow instructor directions. To the maximum extent permitted by law, Aquatic Solutions’ total liability shall not exceed the amount paid for the course. In no event shall Aquatic Solutions be liable for indirect, incidental, or consequential damages. Nothing in this Agreement shall limit liability for gross negligence or willful misconduct to the extent such limitation is prohibited by law. This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any legal action shall be brought exclusively in the state or federal courts located in New York.
Licensed Provider Status: Aquatic Solutions is an American Red Cross (ARC) Licensed Training Provider. All courses are American Red Cross Programs as listed in the title. We strictly adhere to ARC standards.
Terms: Registration and payment secure a seat in a course for evaluation; they do not guarantee certification. When purchasing a course, it is agreed to by the purchaser that they are purchasing a seat for the specific time, date, and location of the training in the program to be evaluated and receive a grade as defined below. Certification is contingent upon the Participant’s ability to demonstrate 100% proficiency in all required skills and pass all written exams.
Grading Definitions:
- Successful is entered for a participant who has successfully attended and participated in all class sessions, including activities and skill sessions and demonstrated proficient competency in all required skills. To receive this mark students also must be prepared with all required equipment for each class. Successful students will receive an American Red Cross Certification in the course taken.
- Unsuccessful is entered for a participant who has not met course objectives and/or has not successfully attended and participated in all class sessions, including activities and skill sessions, demonstrated proficient competency in all required skills, or violated any Aquatic Solutions policies. This mark is also issued for students unprepared with necessary equipment. Unsuccessful students will not receive an American Red Cross certification.
- Not Evaluated is entered as the final grade for a participant who is not attending the course with the intention of receiving a completion certificate. This grade should not be substituted for Unsuccessful for a participant who attempts certification but is unable to pass the completion requirements. A participant who chooses to audit must make their intentions known to the instructor at the beginning of the class. Not Evaluated students will not receive an American Red Cross certification.
Successful Students Only: Only participants who receive a grade of Successful, as defined in these Terms, are eligible to receive an American Red Cross certification. Certifications are issued in digital format only and are delivered via email to the unique and valid email address provided by the participant to the instructor at the conclusion of the course. Each participant must provide their own valid and unique email address in order to receive certification. All certification emails are sent through the American Red Cross digital certification platform. Aquatic Solutions strives to process course records and submit certifications as promptly as possible. Typical certification processing time is twenty-four (24) to forty-eight (48) hours following the conclusion of the course. In no event shall certification processing exceed ten (10) business days from the final day of the course. If a participant does not receive their certification email after the applicable processing period, it is the participant’s responsibility to promptly contact Aquatic Solutions. Failure to do so may result in delays or the inability to process certification. All American Red Cross certifications are issued digitally and may be accessed, downloaded, and shared through the American Red Cross website within approximately seventy-two (72) hours after the course record has been processed: https://www.redcross.org/take-a-class/digital-certificate The participant is solely responsible for ensuring the correct spelling and formatting of their name and email address. A student roster is completed at the end of each class, and participants are required to review and confirm that their name and email are accurate at that time. Aquatic Solutions is not responsible for errors, delays, or reissuance requests resulting from incorrect or incomplete information provided by the participant. To inquire about the status of a certification, participants must contact Aquatic Solutions at help@aquaticsolutions-cpr.com.
Personal Property: Participants are solely responsible for all personal property brought to any Aquatic Solutions training location. Aquatic Solutions is not responsible for the loss, theft, or damage of personal items, including but not limited to clothing, footwear, eyewear, electronic devices, jewelry, wallets, bags, equipment, or vehicles and their contents, whether such loss or damage occurs before, during, or after a course, including while items are stored in locker rooms, pool decks, classrooms, or common areas.Participants are encouraged to leave valuables at home and to secure personal belongings at all times. Use of any storage or locker facilities is at the participant’s own risk.
Medical Consent and Physical Assumption of Risk
Physical Requirements: For Lifeguarding and other aquatic-related classes, training involves strenuous physical activity that may vary depending on the specific course in which the participant is enrolled, including but not limited to deep-water submersion, swimming, lifting, and repetitive chest compressions. CPR and First Aid classes require kneeling, repetitive chest compressions, and general mobility within a classroom or training setting.
Assumption of Risk and Release: The Participant acknowledges that participation involves inherent risks and voluntarily assumes all such risks, whether known or unknown, inherent or incidental. To the fullest extent permitted by New York law, the Participant agrees to release, waive, and discharge Aquatic Solutions, its owners, officers, instructors, agents, and facilities from any claims arising from ordinary negligence.
Participant Warranty: By registering, the Purchaser/Participant represents that the Participant is in sufficient physical condition to participate in the course and is responsible for determining, including through consultation with a healthcare provider if they choose, whether they are able to safely participate.
American Red Cross Licensing and Certification Standards: Aquatic Solutions is a licensed training provider for the American Red Cross (“ARC”) and is required to deliver instruction, evaluate participants, and issue certifications strictly in accordance with ARC program standards and life-saving training objectives. These standards establish specific required skills, assessments, and performance criteria that must be successfully completed in order to earn certification.
Registration is open to all individuals. However, certification is not guaranteed and is contingent upon the participant’s ability to successfully complete all ARC-mandated objectives, including required physical skills and evaluations. Participants who do not meet these objectives will be marked as Unsuccessful and will not receive American Red Cross certification.
ADA Compliance and Accommodations: Reasonable accommodations will be considered to the extent required by applicable law and consistent with American Red Cross Inclusion Guidelines and certification requirements. Aquatic Solutions requires written notice at least three weeks (21 days) in advance of the training date, when reasonably practicable, to allow a reasonable opportunity to evaluate and, where appropriate, implement such accommodation. Individuals may attend a course for educational or audit purposes if permitted by Aquatic Solutions; however, auditing a course does not result in certification and does not substitute for successful completion of ARC requirements. Audit participants remain subject to all safety, conduct, and instructor direction requirements. Certain ARC certifications involve essential life-saving functions and safety-critical skills that cannot be modified or waived. If a participant is unable to perform these essential functions, even with reasonable accommodation, certification may not be possible. Nothing in this section is intended to discourage participation or requests for reasonable accommodation as required by law.
Comprehensive Refund & Transfer Policy
The parties agree that the refund and transfer fees represent a reasonable estimate of administrative costs, instructor commitments, licensing fees, and facility expenses, and are not intended as a penalty. By completing a purchase, you acknowledge that Aquatic Solutions incurs administrative and facility costs immediately upon your registration. The purchaser agrees to follow the below processes:
How to Request a Refund: All emails are time stamped and it is determined eligible based on the time and date the email is received and the above stated policies. All refund requests must be submitted to help@aquaticsolutions-cpr.com. If a refund request is not received via email, it will not be reviewed. If a Refund Request is reviewed and deemed eligible, it will be posted within 2- 4 weeks of being approved. Refunds will only be approved or disapproved via email. Any other form of communication is not valid for approval or disapproval of a refund.
How to Request a Transfer: Transfers need to be made prior to the course start time and use the “Rescheduling Request Form” on the logistics received immediately after registration. Once the “Rescheduling Request Form” is submitted it will be time stamped and our registration representatives will get back to you. All transfer requests can be requested using the reschedule request form using the following link https://www.aquaticsolutions-cpr.com/reschedule-request/ Reschedule request forms are time stamped when the form is submitted by the purchaser to determine eligibility as stated above. The request for transfer will be assessed by an Aquatic Solutions representative and determine eligibility based on the above stated transfer policy. The purchaser’s reschedule request will not be complete until you receive an updated ticket from Aquatic Solutions Representative. It is understood that the reschedule is not complete and that the participant has not been granted a seat in a new course. All rescheduled courses may be canceled. If a rescheduled course is canceled, the participant may select an alternative date, subject to availability. No refund of original enrollment fees will be issued. Discount codes will not be valid for transfer charges.
A. Land-Based Courses (basic level course not involving an in water component- does not include instructor courses)
- Within 72 Hours of Registration (but not within 24 hours of class start): Eligible for a 75% refund (minus a 25% cancellation fee) or a 100% credit for a future class (valid for 1 year).
- After 72 Hours of Registration: No refunds, transfers, or credits will be issued for any reason, including illness or emergencies. Participants may transfer to another date for a $35 transfer fee. Transfer option expires after four (4) months and all transfer requests must be completed within 4 months from the date of registration. Failure to do so will result in forfeiture of enrollment fees.
- Within 24 Hours of Course Start: All Sales Final. No refunds, transfers, or credits will be issued for any reason, including illness or emergencies. Participants may transfer to another date for a $35 transfer fee. Transfer option expires after four (4) months and all transfer requests must be completed within 4 months from the date of registration. Failure to do so will result in forfeiture of enrollment fees
- Online-Only Courses: 100% non-refundable and non-transferable.
- Platform Fees: The registration platform fee (CPREnroll) is paid to a third party and is non-refundable by Aquatic Solutions under any circumstances.
- Unsuccessful: Failure to pass the program or prerequisite assessment results in an “Unsuccessful” grade. No refund is issued, but a $35 reattempt fee may be paid to try again in a future session.
- Missed Class due to any reason (i.e. including but not limited to Family Emergency, Illness, work related conflict, transportation issues, etc..) a $35 reattempt fee may be paid to try again in a future session. This applies to multi-day classes where a participant does not attend all scheduled sessions and misses one or more sessions for any reason.
B. Aquatic-Based Courses (basic level course with in water component – does not include instructor courses)

- Failed Prerequisites or Unsuccessful grade: Failure to pass the initial swim test (Prerequisite Assessment) results in an “Unsuccessful” grade. Any other reason for an unsuccessful mark will result in no refund being issued, but a $100 reattempt fee may be paid to try again in a future session.
- Missed Class due to any reason (i.e. including but not limited to Family Emergency, Illness, work related conflict, transportation issues, etc..) a $100 reattempt fee may be paid to try again in a future session. This applies to multi-day classes where a participant does not attend all scheduled sessions and misses one or more sessions for any reason.
- Lifeguard Course Specific Policies: This policy applies to any course with the word “Lifeguard” in the title. Any participant who is unsuccessful with any of the prerequisites is not allowed to participate in the course for certification purposes. A participant can stay and watch, however they will not be allowed to participate in any hand-on skills. The Pre-Course Assessment for the Lifeguarding course is designed to measure whether a participant has the stamina for the course, and participating in Hands-On skills when the Pre-Course assessment is unsuccessful puts a participant in a safety risk.
The Lifeguarding Course, along with the Pre-Course Assessment, are not a Learn-To-Swim course. Instructors are not responsible for teaching participants how to swim, nor are they responsible for making corrections to strokes. Lifeguarding classes require proficient swimming abilities which are outlined in the prerequisite requirements. At the time of the Pre-Course Assessment beginning, the participants should be adequately prepared to pass these skills. In the event a participant does not pass the prerequisites they can transfer into another offering along with the transfer fee and seek to gain assistance from Aquatic Solutions to be better prepared for the next attempt. Should the participant not wish to continue and transfer into another session their enrollment will be converted into a credit for four (4) months for them to reconsider or be transferred to another participant along with the transfer fee. Failure to do so will result in forfeiture of enrollment fees. Such inquiries will need to be made directly to Help@aquaticsolutions-cpr.com.
In the event the participant is marked as unsuccessful in the course for any reason: a $100 reattempt fee would apply for an additional reattempt of the course at the next available offering with a credit valid for four(4) months from your originally scheduled course. Failure to do so will result in forfeiture of enrollment fees. There is no refund given once a grade of Unsuccessful is issued. To reattempt the class and make the $100 reattempt fee an email must be sent to help@aquaticsolutions-cpr.com After the reattempt fee is made an Aquatic Solutions representative will respond with the next available offerings for the reattempt.
In the event the participant would like to reschedule their originally scheduled course prior to the course the rescheduling policy listed above would apply and any equipment provided to the student from their original class would need to be brought back for the reattempt course.
There is no refund given for any students who do not attend their scheduled course. There is no refund for any student who does not pass a course for any reason. If a student does not pass, they will not be granted any form of refund, and would need to re-enroll for a course using the above mentioned reattempt option.
Lifeguarding Course Transfer Enrollment Option Policy: This transfer enrollment applies to any course with the word “Lifeguard” in the title. In the event that a participant decides to, for any reason, not continue with the course and does not wish to reattempt there is no refund however they can transfer their enrollment to another participant for a one time fee of $100.00 paid by the new participant and valid for a period of four (4) months that this transferred enrollment can be used. This fee also includes 1 brand New Sealed Pocket Face Mask resuscitation Combo set for the transferred participant. Enrollment cannot be transferred more than one time and is subject to review and approval by Aquatic Solutions should a transfer request be made. Any transfers made to another participant will have the original participant’s registration null and void with new logistics sent to the new participant. There will be no refund given for the original participants registration for a transferred Enrollment. Transferred courses follow the same general refund policy terms as all Aquatic Solutions courses.
- Instructor Courses Policy: This policy is designated for any course registered with the title “Instructor” or “Instructor Trainer.” Any participant enrolling in an Instructor Course assumes the responsibility of passing the Pre-Course/prerequisite Assessment as well as presenting valid requirements for the course. This includes having the correct Basic/Provider level certifications. Aquatic Solutions conducts all Instructor courses as outlined by the American Red Cross and there is no exception to conducting these assessments. Instructor courses are not designed to teach you Base/Provider level skills, and The Instructor Trainers teaching the course will not be able to reassess after the maximum amount of assessment is conducted. All Skills must be demonstrated to standard as outlined in the Instructor Manual and as demonstrated in the videos. Any participant who does not pass, wants to transfer their course to another class date, or is marked as unsuccessful during their registered course is able to reschedule their course to the next available course offering after making the following rescheduling fee of $150.
All reattempt requests must be emailed to help@aquaticsolutions-cpr.com within four (4) months from the purchase date in order to be eligible for a transfer. Failure to do so will result in forfeiture of enrollment fees. If a reattempt is not desired, a refund would not be an option, as a grade was given for services. The refund policy, as stated in these terms, would apply and the participant grade of unsuccessful or not evaluated will be the participant’s final grade in which the registration fee is applied. Reschedule courses are not guaranteed to run and may cancel. If a rescheduled course is canceled, the participant may select an alternative date, subject to availability. No refund of original enrollment fees will be issued.
E. General Registration and Email Responsibility: It is the responsibility of the participant registering, or any individual registering a participant (including a parent, guardian, or employer), to ensure that all registration information is accurate and complete, including providing a valid and correctly spelled email address. All course correspondence, logistics, online access instructions, and certification-related communications will be sent to the email address provided at registration. Aquatic Solutions is not responsible for missed communications resulting from incorrect, incomplete, blocked, filtered, or full email inboxes. Participants who fail to receive course logistics or online access information due to such issues will remain subject to all transfer, rescheduling, and refund policies contained in these Terms, including where such issues affect the participant’s ability to attend or complete a course. It is the responsibility of the participant to maintain a working email account and to regularly monitor their inbox, including spam, junk, or clutter folders. If course logistics are not received within a reasonable time following registration, the participant must promptly contact Aquatic Solutions at help@aquaticsolutions-cpr.com to request that logistics be resent. Aquatic Solutions may resend logistics to a corrected email address upon request but is not responsible for delays or consequences resulting from incorrect contact information. Individuals registering participants on behalf of others, including parents, guardians, or employers, are responsible for ensuring that the correct email address for the intended participant is provided so that all required communications reach the participant in a timely manner.
Blended Learning & Online Requirements
For all courses designated and listed as “Blended Learning” or “BL” in the title or requiring an online completion, it is the course participant’s responsibility to successfully complete the Online materials and failure to do so would result in an unsuccessful mark. The participant must have all the necessary minimum components listed on the ARC website. It is not recommended to complete the online session on any other device not recommended by the ARC. No refund will be issued for any issues completing the online portion of the course.
Mandatory Pre-work: For Blended Learning or Blended “BL” courses, the online portion is a strict prerequisite. For ample time to complete the online portion it is not recommended to complete the online portion within 72 hours of the course start date and time. It is the responsibility of the participant and purchaser to complete the online portion 72 hours before the course begins to allow for any necessary troubleshooting. For ample time for troubleshooting, It is the responsibility of the participant or purchaser to contact the American Red Cross and notify Aquatic Solutions(with ARC case number) of their inquiry with 72 hour notice for any troubleshooting request. Participant assumes the risk of delayed or incomplete access to third-party platforms. Third-party websites are not controlled by Aquatic Solutions and content may change without notice.
Proof of Completion: Participants must present the “Online Completion Report” at the start of the in-person session.
Failure to Comply: Arriving without proof of completion, or failing the online component, constitutes for an unsuccessful mark in the course. No refunds or free reschedules are provided. Technical issues with the Red Cross website are beyond our control; contact ARC support for troubleshooting. Failure to do so will result in an unsuccessful mark in the course and forfeiture of registration fees. It is not recommended that any online portion is done within 72 hours or at the last minute and the purchaser and participants understand the risk of the unsuccessful mark if they attempt to not have the online portion completed prior to 72 hours of the course start date.
Pre-Course and Prerequisite Assessments Policy
For any courses with Pre-Course/prerequisite Assessments: Pre-Course or Prerequisite assessment means that the materials or physical skills must be completed(materials) or perfected(physical skills) before the beginning of any course. It is the first thing done on Session 1 of the course, and cannot be assessed after the Pre-Course/prerequisite assessment portion of the course has finished. Aquatic Solutions administers all Pre-Course/prerequisite assessments as required by the American Red Cross. It is the responsibility of the student to prepare for any Pre-Course/prerequisite assessments prior to the first day. Any participants marked unsuccessful in the Pre-Course/prerequisite assessment are ineligible to participate in the course for certification, but can stay and watch the duration of the course.
Attendance and Conduct
Lateness: It is the responsibility of the participant to arrive at their class on time.Classes begin exactly at the time listed and it is recommended students arrive 15 minutes early to ensure they are able to find the correct location for the class. Late arrival is disruptive and prevents the completion of mandatory ARC minimum time to complete the course. Lateness results in an “Unsuccessful” mark. A $35 transfer fee applies if a transfer is permitted. All transferred classes are not guaranteed to run and in the case of a transferred class is confirmed but canceled due to low enrollment or any other reason the participant can be offered a transfer into an alternate class or a refund of the $35 transfer fee. There is no refund for the original class. The original enrollment fee has already been applied to the course they selected and services have been rendered for that offering since a seat was reserved and a grade was issued.
Behavioral Standard: Aquatic Solutions, Inc. strives to maintain a safe and supportive teaching environment for all participants. Disruptive behavior is prohibited in any of our classes. Disruptive behavior is any behavior including but not limited to which Aquatic Solutions regards as speech or action which is disrespectful, offensive, and/or threatening, interferes with the learning activities of other students, impedes the delivery of instructional services, and/or has a negative impact in any learning environment or towards a customer support representative. Disruptive behavior includes including but not limited to physically, verbally or psychologically harassing, threatening, or acting abusively toward an instructor, staff member, or toward other students in any activity conducted by Aquatic Solutions. Aquatic Solutions reserves the right to remove any participant who violates this policy. Aquatic Solutions also reserves the right to withhold any customer from returning should they violate this policy. Aquatic Solutions reserves the right to remove any participant who displays disrespectful, offensive, or threatening behavior toward staff or other students. Removal for behavior results in a permanent forfeiture of fees. Removal decisions are final and made at Aquatic Solutions’ sole discretion. This Behavior Standard also applies to parents, guardians or employers who confront any employee or facility staff associated with Aquatic Solutions in the above mentioned manner.
Certification Information Responsibility: Upon successful completion of a course, each participant is required to provide their full legal name, email address, and phone number as part of the certification and record-keeping process. This information is completed by the participant and collected by the instructor at the conclusion of the course. It is the participant’s sole responsibility to ensure that all certification information provided is accurate, complete, and correctly spelled at the time it is submitted. The name provided by the participant will be used exactly as written for the American Red Cross certification, and the email address provided will be used to send the participant’s certification and/or digital certificate notification. Aquatic Solutions is not responsible for errors, delays, or reissuance requests resulting from incorrect, incomplete, or illegible information provided by the participant. Participants are responsible for reviewing and confirming their information at the end of class when the instructor collects this information. Requests for corrections submitted after class may be subject to administrative fees and American Red Cross processing requirements and are not guaranteed. Written Exam and Retest Policy
Written Exams: If a participant fails a written exam, they are permitted one (1) retest within 10 days of the course end date as long as ARC programming allows. Retest availability is subject to instructor and facility availability. If they cannot attend these dates and availability a $50 fee would apply to schedule a customized session.
Written Exam Retake Fee: All customized retake exam sessions are subject to an administration fee of $50 per exam session if the participant is not able to attend the dates and times provided.
Written Exam Retest Failure: Failing the second attempt requires the participant to re-register and pay for the full course again.
Administrative Fees and Disputes
Chargebacks: Any chargeback that is not resolved in Aquatic Solutions’ favor may result in recovery of reasonable administrative and processing costs incurred in responding to the dispute. Any credit card chargeback or “unrecognized charge” dispute filed with your bank will result in administrative costs, processing fees, or investigation expenses that will result in a fee of $40 added to the original cost of the course. This fee reflects actual administrative and processing costs incurred.
Form Completion: Requests for instructors to sign employment or verification forms after the course date incur a $30 processing fee. There is no charge for this service if participants bring the form to the class they are attending and present it to the instructor on their scheduled date to validate and sign.
Health Safety
By attending, you agree to follow all on-site sanitization and PPE protocols.
Equipment Requirement Policy: In select classes, and in accordance with applicable CDC guidelines, Aquatic Solutions provides fully cleaned and sanitized reusable adult and pediatric training pocket face resuscitation masks for use during class. Each participant will receive a brand-new disposable one-way valve for use with the sanitized reusable mask. The mask must be returned to Aquatic Solutions at the end of the class. Participants who prefer to use their own equipment may purchase a brand-new, sealed resuscitation mask set, which may include a storage pouch, additional gloves, and a disinfectant wipe. Purchased equipment is the participant’s property and may be retained for personal use. If purchased, such equipment must be brought to all applicable training sessions. Lost, misplaced, or stolen equipment must be repurchased at the participant’s expense. Any equipment purchased outside of Aquatic Solutions must be approved for use under the applicable American Red Cross program guidelines for the course in which the participant is enrolled. Participants who bring their own equipment assume the risk that such equipment may not be permitted for use if it does not meet American Red Cross requirements. All required equipment and materials specified in the course description, registration materials, or course logistics must be brought to each class session. Failure to arrive with required equipment may result in an Unsuccessful grade and may limit the participant to audit-only attendance, at Aquatic Solutions’ discretion, with no refund or free reschedule.
Gift Certificates and Discount Codes
Discount Codes do not Stack with Gift Certificates or any valid offer. The validity of a coupon code is only valid if it is inputted and is accepted by the Aquatic Solutions registration process. Any codes not accepted are considered invalid and void. Discounts cannot be applied if any course is put for a discounted rate. Aquatic Solutions reserves the right to terminate a Gift Certificate if a customer uses any discount/promo codes to purchase Gift Certificates.
Gift Certificate Refund Policy: All Gift certificates are All Sales Final. All Sales Final means that there are no refunds for any Gift Certificate and that the purchaser acknowledges that once purchased, they are not entitled to a refund. Gift Certificates cannot be redeemed for Cash value.
Gift Certificate Validity: Gift Certificates are valid for One (1) Year of Purchase date. After this date, the Gift Certificate converts to a credit equal to the amount paid for the Gift Certificate, and any difference in the listed price and the Gift certificate will have to be paid by the person redeeming the Gift Certificate.
How to Redeem: A Gift Certificate be redeemed by either the purchaser or the participant listed on the Gift Certificate. If the Gift Certificate is transferred to another person, the Purchaser would need to email Aquatic Solutions in order to transfer the Gift Certificate to another person. To redeem the Gift Certificate, please email help@aquaticsolutions-cpr.com with the Gift Certificate. Aquatic Solutions will redeem your Gift Certificate and provide you with a Single Use Code that can be redeemed upon checkout on our website. Gift Certificates can only be redeemed for courses listed on the Gift Certificate. They cannot be transferred to other offerings aside from courses listed on the Gift Certificate. Once the Gift Certificate is redeemed, it cannot be used again.

Definitions and Clarifications
“All Sales Final”: All Sales Final means that once a transaction is completed, the purchaser is not entitled to a refund, credit, or transfer of funds under any circumstances.
Prerequisite Assessment: A mandatory evaluation of physical skills (like swimming) or materials that occurs at the very beginning of Session 1. Failure here immediately renders the student ineligible for certification.
Blended Learning (BL): A course format requiring the completion of online modules prior to the in-person session. Failure to provide proof of completion at the start of class results in an “Unsuccessful” mark.
Platform Fee: A non-refundable fee paid to a third-party provider (CPREnroll) that Aquatic Solutions cannot recoup or refund.
In water component: Any course element requiring physical participation in a swimming pool or aquatic environment, including swimming, submersion, rescue skills, or other water-based evaluations.
Basic Level Course: A “Basic-Level Course” is an American Red Cross training program designed to teach foundational life-saving knowledge and skills to participants for personal, workplace, or professional use. Basic-Level Courses focus on skill acquisition and evaluation but do not authorize the participant to teach, train, or certify others. Examples include, but are not limited to, CPR/AED, First Aid, Basic Life Support (BLS), Lifeguarding, and Water Safety courses.
Instructor-Level Course: An “Instructor-Level Course” is an advanced American Red Cross training program intended for individuals seeking authorization to teach, evaluate, and certify participants in applicable American Red Cross programs. Instructor-Level Courses require participants to meet prerequisite certifications, demonstrate mastery of provider-level skills, complete instructor-specific assessments, and comply with all American Red Cross instructor standards. Instructor-Level Courses do not reteach basic life-saving skills and are not designed as remedial or learn-to-perform programs.

Agreement
By checking the “I Agree” box or completing payment, the Purchaser acknowledges they have read, understood, and agreed to be bound by these terms, specifically noting the No Refund policy for late arrivals and failed prerequisites. These Terms constitute the entire agreement and may only be modified by Aquatic Solutions. Electronic acceptance constitutes a legally binding signature. If any provision is held unenforceable, the remaining provisions shall remain in full force and effect. Aquatic Solutions shall not be liable for cancellations or delays caused by events beyond its reasonable control, including but not limited to weather, facility closure, public health emergencies, or government action. The Participant agrees to indemnify and hold harmless Aquatic Solutions from any claims arising out of the Participant’s conduct, violation of these terms, or failure to follow instructor directions. To the maximum extent permitted by law, Aquatic Solutions’ total liability shall not exceed the amount paid for the course. In no event shall Aquatic Solutions be liable for indirect, incidental, or consequential damages except to the extent caused by Aquatic Solutions’ gross negligence or willful misconduct except to the extent caused by Aquatic Solutions’ gross negligence or willful misconduct. This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any legal action shall be brought exclusively in the state or federal courts located in New York. Provisions regarding limitation of liability, indemnification, refunds, and governing law shall survive termination. Participants may not assign or transfer rights without written consent. The Participant acknowledges that participation in training involves inherent risks, including but not limited to physical exertion, water activities, equipment use, and emergency-response simulations. The Participant voluntarily assumes all such risks, whether known or unknown, inherent or incidental, and agrees to release, waive, and discharge Aquatic Solutions, its owners, officers, instructors, agents, and facilities from any claims arising from ordinary negligence to the fullest extent permitted by New York law.
